Payment and Refund Policy

1. Payment and Refund

The Platform is a paid service and the payments made by You shall be according to the plans opted by You through the Platform. You explicitly agree to pay the fees for the plans that you purchase, and you authorize the Company to charge you as per the applicable payment mode opted by you. All payments shall be through the payment mechanism put in place by the Company and You shall be responsible for paying all fees and applicable taxes in a timely manner as per the mechanism associated with the Plan availed by You. Users have been given various options to choose and proceed with the payment for the Services via payment mechanisms including but not limited to Card Payment facilities, UPI, EMI Payment, Online Bank Transfer and Wallet Payment. With reference to Clause 2, the payment gateway mechanisms are governed by the terms and conditions of the third-party providers as listed on the Platform and the User agrees to be bound by those terms.

Valid Credit / Debit/ Cash Card/ online bank transfers and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms agreed to between the Users and the respective issuing bank and payment instrument issuing company. We shall not be liable for any unauthorized use, fraud, payment refunds, lost amount etc. in the transaction. The amount of refund payable shall only be limited to the amount paid by the User for Services which were not rendered to the User by Us. In case of refund of EMI transactions, User will be charged interest as per bank’sregulations.

The cancellation and refund are not applicable on the Short-Term Plans of Less than a month. The refund request willonly be applicable for the Long-term Plans which are more than a month. The refund amount will be based on the daysleft for the validity of Plan. We attempt to process and complete refund requests within 48 hours from the time ofreceiving the refund request, however, in case there is any delay in refund beyond the period of 96 hours, then youmay notify usongeniecare@yoursilvergenie.com. The refund process may include a feedback call to you andvalidation of key information that may be required by us to process the refund request. We reserve the right to change any fees at any time at our sole discretion and any change, update, or modificationin the fee shall become effective immediately upon the same being posted/uploaded or notified on our website.

2. Third Party Services

You acknowledge that the Services provided by the Company uses and/or contains certain softwares, products andservices which are developed and owned by third parties, the use of which is governed by terms and conditions ofsuch third parties. Please read the User Agreement and Privacy Policy for these sites separately before using thesaid third party websites. By accessing the said third party websites, you agree to be bound by the respective useragreement and privacy policy of these third parties. Accordingly, you agree that the Company will not beresponsible for such Third-Party software, products and services nor for any error, malfunction or defect in theService resulted therefrom.”

3. TeleMedicine Consultation and Call Facility:

Silvergenie enables Users to connect with Practitioners through two methods: a) Book facility that allows Usersto book an appointment through the Website; b) Value added telephonic services with Concierge engagement.

3.1 Silvergenie will ensure Users are provided confirmed appointment on the Book facility. However, Silvergenie hasno liability if such an appointment is later cancelled by the Practitioner, or the same Practitioner is not availablefor appointment.

3.2 The results of any search Users perform on the Website for Practitioners should not be construed as anendorsement by Silvergenie of any such particular Practitioner. If the User decides to engage with a Practitionerto seek medical services, the User shall be doing so at his/her own risk. 3.3 Silvergenie is providing Healthcare and diagnostic services through Registered medical Practitioners. However, Silvergenie is not responsible for any interactions between User and the Practitioner. User understands andagrees that Silvergenie will not be liable for:

(a) User interactions and associated issues User has with the Practitioner
(b) the ability or intent of the Practitioner(s) or the lack of it, in fulfilling their obligations towards Users;
(c) any wrong medication or quality of treatment being given by the Practitioner(s), or any medical negligence on part of the Practitioner(s);
(d) inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Practitioner to provide agreed Services;
(e) any misconduct or inappropriate behaviour by the Practitioner or the Practitioner’s staff

3.4 Cancellation and Refundwill be applicable on case-to-case basis. If the User cancels the scheduled consultationcall, it will not be refundable. If the Doctor/Consultant, for some reason, cancels the call/does not attempt the call, it will berescheduled by SilverGenie for the same consultant and if he is not available, User can schedule the call with any otheravailable Doctor/Consultant. The price difference will be paid by the User.
